GENERAL
Breaking the T.O.S policy will result in necessary actions being taken + I will not work with you in the future.

Do not use my art in anything relating to N/F/T/s or A/I generation. I do not consent.

Do not reupload my art, though commissioned art may be uploaded/used with credit.
-
Do not trace/copy/heavily reference my art.
-
Please write in a clear and respectful manner.
-
I communicate through Discord and Twitter DMs.
PAYMENTS
-
Payments are processed through Paypal or VGen only.
-
I will need your email to send the Paypal invoice after we discuss the commission.
-
You must be 18 years old or older to order a LIVE2D commission.
-
LIVE2D commissions may be paid half-half if desired (before starting the art and the rest before rigging).
BEFORE ORDERING
-
Visual character reference must be included, with color preferred.
-
If you do not have a visual reference, you may be charged a design fee.
-
Be clear with any specific poses, props/items, and expressions you want.
-
I have the right to decline to work with uncomfortable content/character designs that I don't believe will look good in my style. This means full mech/NSFW or designs that would be hard to translate into my style. Designs with heavy detail may be declined or I may omit small details. I do not like to draw complicated patterns/things like lace or color gradients. I do not like to draw certain modern clothing styles/technology. I will not draw branded clothes. I will not draw in the style of another artist/media. Just ask if you're unsure!

I have the right to refund commissions, even after I have already started/accepted it.
PROCESS/REVISIONS

Work in Progress(WIP)s may be requested & I often send WIPs to check if you want to make any adjustments.

I will send you sketches and progress updates. Please let me know during that time ANY changes you'd like to make.

Any small edits after finishing the commission are okay. Talk to me about it and we'll work it out. Major changes being made after the art is finished, such as redrawing a large area, may result in a fee.

I might stream the process on my Twitch and/or upload a speedpaint on Youtube. If you are not OK with this/you'd like to keep the commission under NDA, let me know.

DEADLINES AND DELIVERY

Turnaround time varies between 1 week to 4+ months depending on a variety of factors; order of the commission, complexity, personal health, etc. If I can't meet the deadlines I suggested/we agreed upon, I'll be in contact with you throughout.

Express turnaround time of 1-2 days (not available for live2d) is an additional $50 fee.

Finished commissions are shared through a google drive link or through files sent to dm.
-
With every finished LIVE2D model, an instruction text document is included.
-
LIVE2D models are made for use with Vtube Studio.

REFUNDS
-
Refunds may be granted anytime before I start the commission, plans can change, I understand. After starting the sketch cleanup/coloring, I will only provide a 50% refund. After that, no refund can be granted.

USE + INTELLECTUAL PROPERTY RIGHTS

LIVE2D COMMISSIONS
Rights to LIVE2D commissions are different from other commissions, LIVE2D commissions include commercial price/rights.

The commissioner/client is allowed to;

Use the model within content creation and self-promotion.

Claim the right of your character.
​
The commissioner/owner is NOT allowed to;
-
Give the model to someone else/sell it. (Contact me first)
-
Trace/edit the model or claim my artwork as their own.
-
Release the model online or share the texture sheet with anyone.
​
As the artist and rigger of the model, I retain these rights;
-
Use the model as an example for my portfolio.
-
Upload videos/images of the model online.
-
Promote myself as a LIVE2D creator with it.
-
Use it in commission examples.
-
Upload process videos of the creation.
-
Require credit to me, moyasi/@m0yasi_, as the creator of your model.

REGULAR COMMISSIONS
I, the artist, hold every right to the produced illustration (not character), not the commissioner.​
​
The commissioner is allowed to;
-
Use the artwork for personal use only unless agreed otherwise.
-
You may use the art in streams/content creation, with credit.
-
Print the art for personal use, and claim the right of their character(s) but not the drawing itself.
-
Use the art to promote themselves with proper credit given to me, the artist.
​
The commissioner may NOT [the following is considered copyright infringement];
-
Reproducing/using the commissioned artwork in merch, unless discussed with me.
-
Taking credit for the creation of the artwork.
-
Not crediting me.
-
Removing any watermarks/signatures.
-
Altering the artwork without my, the artist, consent.
-
Use the artwork in A/I training or N/F/Ts.
As the artist of the commission, I retain these rights;
-
Promote myself with the art within any place or site and include it in my portfolio/commission examples.
-
If it is not an original character (i.e. Hatsune Miku), create merch with it, such as prints and stickers.

COMMERCIAL RIGHTS
You may purchase commercial rights to sell merch. Commercial rights do not mean you own the art, but you are allowed to sell merch of it. Even without purchasing commercial rights, you are still permitted to use commissioned art in streams, thumbnails, etc., and other forms of promotion (credit required).
A purchase of commercial rights to the artwork will always be 300% of the original price.

With commercial rights, the commissioner is allowed to;

Make any sort of merch with the artwork with credit to me, moyasi/@m0yasi_ in the product description. Credit is still required for the usage of the artwork.

Use it to your liking and promote your own brand.

Use the artwork for personal use only unless agreed otherwise.
-
You may use the art in streams/content creation, with credit.
-
Print the art for personal use, and claim the right of their character(s) but not the drawing itself.
-
Use the art to promote themselves with proper credit given to me, the artist.

With commercial rights, the commissioner may NOT;

Edit the artwork or make drastic visual changes.
-
Taking credit for the creation of the artwork.
-
Not crediting me.
-
Removing any watermarks/signatures.
-
Altering the artwork without my, the artist, consent.
-
Use the artwork in A/I training or N/F/Ts.

As the artist of a commission with commercial rights, I am allowed to;
-
Promote myself with the art within any place or site and include it in my portfolio/commission examples.
